Job Description

Litigation:-
Advising all Group Companies on civil, criminal, contractual, restrictive trade practices, property related and intellectual property issues.
Supervising all litigation including prosecution of civil, criminal and customs cases in the High Court, Civil Courts and Tribunals.
Drafting of commercial contracts, charter parties, Memorandums of understandings, technology transfer agreements, loan facility etc
Drafting of deeds and documents such as leases, guarantees, bonds, indemnities, service agreements etc.
Negotiating out-of-court settlements and participating in alternative modes of dispute resolutions
Supervising and conducting arbitration proceedings.
Appearing before Governmental and quasi-judicial authorities.
Evolving litigation strategies.
Liaisoning with Solicitors and Advocates.

Appearing before Supreme Court, High Court, Subordinate Courts, Tribunals, etc. for resolving criminal, civil, labour, taxation and medico legal cases.
Managing IPR issues involving registration of trademarks, patents & copyrights of the company, initiating appropriate legal action against infringers.
Handling and drafting of statement of claim/counter claims for Domestic and International Arbitration on behalf of companies.
Preparation and drafting of claims for arbitration and handling the same in arbitration proceeding for and on behalf of the company.

Land Acquisitions / Legal Matters:-

Land Identification with survey team & land revenue dept for project purpose.

Date fixation for joint inspection & spot verification.

Joint inspection wit land revenue & forest dept for project purpose.

N.O.C. taken from Land owners & Panchayat.

Preparing of Land compensation.

Land acquisition process done under compulsory acquisition.

Releasing of Compensation.

Land compensation disbursement to land owner.

Taking over of land/houses.

Land demarcation done.

Mutation of private land done.

Starting of project work by contractor.

Coordination with land owners & contractor for smooth running of work on negotiation with land owners.

Documentation:-


Drafting and vetting of Joint Ventures, Technology Transfer Agreement.

Drafting and vetting contracts, agreement and Joint venture, franchise agreements and various other legal documents viz. MOUs, Property documents, lease agreements, etc.

Preparing Writ Petitions, Plaints, Case Papers, Appeals, Counter Affidavits, etc. for submission/pleadings for various legal proceedings.

Relationship Management:-

Appointing and maintaining sustained contact with legal professionals for initiating and follow-ups on legal procedures and finalizing various legal agreements.

Providing expert advisory services on various legal, labour and HR matters.

Manage & Minimise Business Risk:-

To ensure that all legal issues referred for advice, agreements & deeds for creation/vetting are taken maximum care in the light of prevailing facts & laws. Take care of gray areas while negotiating & finalizing documents. Conduct due diligences. Provide appropriate solutions on legal issues. Generally address issues relating to compliances.

Knowledge Sharing:-

To ensure that changes in applicable laws & landmark cases are brought to the knowledge of top management and concerned officials to enable them to take care of such changes in business negotiations & expansion plans etc.

Corporate Legal Issues:-

To take care of all preventive measures to minimize litigation & to manage litigation in efficient manner, play effective roll in negotiations, extend full legal support in business decisions, development, expansions, merger, demerger, and acquisition. Ensure professional development of team members and utilize resources in very efficient manner.
